در دنیای صنعتی این روزها طرحها و اختراعاتی ساخته میشود که برای آن میتوان یک نام تجاری دست و پا کرد اما شیوه کارایی آن متفاوت است. همین خودکاری که در دست دارید برای نوک آن صدها نوع اختراع به زبانهای مختلف وجود دارد که نام آنها همان نوک خودکار است اما روش کارکرد آنها با یکدیگر متفاوت است تا نرمی و راحتی بیشتری به خودکار بدهد. آیا این نقض حریم قانونی است؟ اگر به این شکل بود که صدها حکم قضایی برای آن تشکیل میگردید و برای مخترع آن احکامی صادر شده بود تا درس عبرتی برای دیگران باشد.

بنده در اداره ثبت مالکیت های مدنی بارها به این قضیه برخورد کرده ام که اختراع عنوانی داشت که برای همگان آشنا بود مانند همین نوک خودکار اما شیوه کارکرد آن متفاوت بود. پس باید بگوییم که حریم آن نقض شده و نباید ثبت شود در صورتیکه مخترع در برگه ادعای اختراع آنرا به شیوه ای معرفی کرده که با تمام نوک خودکارهای که تاکنون ساخته شد، تفاوت بسیار چشمگیری داشته است.
در دعواهای حقوقی میان سامسونگ و میکروسافت از این موارد بسیار زیاد دیده میشود که با کمی تحقیق میتوان این موارد را پیدا کرد.
